The Service Provider and the Participant, collectively referred to as the "Parties," hereby agree to the following terms and conditions for the provision of NDIS services:

 

 

  1. Scope of Services: The Service Provider agrees to provide cleaning services to the Participant as specified in the NDIS plan, including but not limited to residential cleaning, laundry assistance, and other related tasks as agreed upon by both parties (the "Services").

  2. Service Delivery: The Parties shall collaborate to develop a Service Agreement and a schedule for the delivery of Services, taking into account the Participant's needs and preferences. The Service Provider shall make reasonable efforts to accommodate any changes or modifications to the agreed-upon schedule, subject to prior notice and availability.

  3. Service Rates and Payments: The Parties agree to the rates set forth in the Participant's NDIS plan or as otherwise agreed in writing. Payment for Services will be made according to the NDIS payment schedule or any other agreed-upon payment method.

  4. Responsibilities of the Service Provider: (a) The Service Provider shall ensure that all personnel delivering the Services are appropriately trained, qualified, and possess relevant police clearances or checks, where required by law. (b) The Service Provider shall maintain appropriate liability insurance coverage to protect both the Participant and the Service Provider. (c) The Service Provider shall comply with all applicable laws, regulations, and NDIS guidelines regarding the provision of services.

  5. Responsibilities of the Participant: (a) The Participant shall provide a safe and suitable environment for the Service Provider's personnel to carry out the Services. (b) The Participant shall promptly communicate any changes or modifications to the agreed-upon schedule or Services. (c) The Participant shall provide necessary information to enable the Service Provider to deliver the Services effectively.

  6. Confidentiality: Both Parties shall treat all information obtained during the course of this Agreement as confidential and shall not disclose it to any third party without prior written consent, except as required by law.

  7. Termination: Either Party may terminate this Agreement by providing 30 days' written notice to the other Party. However, termination will not affect any rights or obligations arising prior to the termination date.

  8. Dispute Resolution: In the event of any dispute arising from this Agreement, the Parties shall first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation, the Parties agree to seek mediation or other alternative dispute resolution methods.

  9. Amendments: This Agreement may be amended or modified only in writing and signed by both Parties.

  10. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Victoria/Australia, without regard to its conflict of laws principles.

 

Service Rates and Payments:

The Parties agree to the rates set forth in the Participant's NDIS plan or as otherwise agreed in writing. Payment for Services will be made according to the NDIS payment schedule or any other agreed-upon payment method.

 

1. Cancellation Policy: The Participant may cancel any scheduled Services by providing a minimum of 24 hours' notice in writing. In the event that the Participant fails to provide the required notice, the Participant may be responsible for a cancellation fee as agreed upon by both Parties. The cancellation fee shall not exceed the full cost of the scheduled Services.

 

2. Rescheduling: In case the Participant wishes to reschedule a Service, they must inform the Service Provider at least 24 hours before the original scheduled time. The Service Provider will make reasonable efforts to accommodate the rescheduling request, subject to prior notice and availability.

 

 

3. Service Provider Cancellation: In the unlikely event that the Service Provider needs to cancel a scheduled Service, the Service Provider shall provide the Participant with a minimum of 24 hours' notice, except in cases of unforeseen circumstances or emergencies. In such cases, the Service Provider shall work with the Participant to reschedule the Service at the earliest mutually convenient time.

 

The Parties acknowledge and agree to abide by this 24-hour cancellation policy to ensure efficient service delivery and minimize any inconvenience caused.
